Terms of Service

Please read these terms carefully before using the Discuse API.

1. Acceptance of Terms

By accessing or using the Discuse API and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Services.

2. Description of Services

Discuse provides AI-powered content moderation APIs that enable developers to analyze text and images for spam, toxicity, NSFW content, and other policy violations. The Services include the API endpoints, documentation, dashboard, and any associated tools or SDKs.

3. Accounts and API Keys

You must create an account and generate an API key to access the Services. You are responsible for maintaining the confidentiality of your API keys and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or API keys. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not: (a) use the Services to process content that you do not have the right to analyze; (b) attempt to reverse-engineer, decompile, or extract the underlying models or algorithms; (c) use the Services to build a competing product; (d) exceed rate limits or circumvent usage restrictions; (e) share API keys with unauthorized third parties; (f) use the Services in any way that could damage, disable, or impair the Services.

5. Service Level Agreement

Discuse targets 99.5% uptime for all paid plans. Scheduled maintenance windows will be communicated at least 48 hours in advance. In the event of unscheduled downtime exceeding the SLA, paid customers may request service credits proportional to the downtime experienced. The Basic (free) plan is provided on a best-effort basis without uptime guarantees.

6. Billing and Payments

Paid plans are billed monthly or annually, as selected at the time of purchase. Overage charges are billed at the end of each billing cycle based on actual usage above included limits. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days advance notice. Continued use of the Services after a pricing change constitutes acceptance of the new pricing.

7. Data Processing

Content submitted to the API is processed in real-time for the sole purpose of generating moderation results. We do not store the content you submit beyond the time required to process the request. Aggregated, anonymized usage statistics may be collected to improve the Services. For detailed information about our data practices, please refer to our Privacy Policy.

8. Intellectual Property

The Services, including all models, algorithms, software, documentation, and trademarks, are the property of Discuse or its licensors. You retain all rights to the content you submit to the API. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

9. Limitation of Liability

The Services are provided "as is" without warranties of any kind, whether express or implied. Discuse does not guarantee that moderation results will be 100% accurate. To the maximum extent permitted by law, Discuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees owed, or if we are required to do so by law. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law.
